Contractor Management
Business relationships with suppliers are inherently risky:
- When you contract with an outside company or self employed person to conduct work on your premises and you direct their work, then you become a "Contractor" under The Manitoba Workplace Safety & Health Act. As such, you are responsible for managing the safety and health risks that you can control. This means implementing a system to ensure proper management of the safety and health risks associated with the work they will be doing.
- When you hire a supplier who does not have WCB insurance and one of their employees is injured in your workplace, you could be held responsible to pay the WCB Costs.
- Do your suppliers carry liability insurance? Do they have a Safety Management System? Do they provide safety training to employees? Do they have proper Safe Work Procedures.
You must evaluate the Safety Management System (or lack of one) of all employers and self employed workers before the work begins. Collecting and managing information can reduce risk.
mySafetyAssistant simplifies contractor / supplier evaluation and monitoring and creates a permanent record for your due diligence.
Are you considering a small renovation of your workplace where you're coordinating the work of a few trades such as a carpenter, electrician and plumber? Did you know that you could be a Prime Contractor? As such, you are legally responsible for:
- Ensuring everyone involved in the work project meets their legal safety and health obligations.
- Coordinating, organizing and monitoring work on the project to ensure reasonable and practical precautions are in place to control safety and health hazards.
REMEMBER: If your evaluation of sub-contractors, contracted employers or self employed persons wasn't documented, it didn't happen.
